How long does the trademark process take?
The USPTO typically takes 8–12 months to review a straightforward application. If there are no conflicts and no Office Actions, registration can be finalized within that window. The filing itself happens within days of your brief being submitted.
What happens if my mark is rejected by the USPTO?
The USPTO issues an Office Action explaining the grounds for refusal — common reasons include likelihood of confusion with an existing mark or descriptiveness. Do I really need an attorney to file a trademark?
You don't — but mistakes in the application are common and can be costly. Misclassifying goods and services, filing under the wrong basis, or missing a conflict in the search are problems that lead to rejection or weak protection. Attorney-filed applications have significantly higher approval rates.
What is the difference between TM and the registered ® symbol?
TM can be used on any mark you claim as your trademark, even before registration. The ® symbol can only be used after the USPTO grants federal registration. Using ® before registration is a federal violation.
Can I trademark a name that already exists in a different industry?
Possibly. Trademark protection is tied to specific goods and services, so the same word can be registered by different parties in unrelated fields.
